Starting from July 1, 2018, all units are required to have a physical security risk analysis.
As of July 1, 2018, the postponement of the deadline until which units established before June 16, 2012 were exempted from carrying out the physical security risk analysis ceased to have its effects.
Thus, after this date, all units are required to have a physical security risk analysis, failure to do so is sanctioned with a fine from 10,000 to 20,000 lei.
Law no. 333/2003 regarding the protection of objectives, goods, values and the protection of persons, provides that: "Ministry and other specialized bodies of the public administration (...), companies regulated by Law no. 31/1990, regarding commercial companies, regardless of the nature of the share capital, as well as other organizations that hold assets or values under any title, referred to in this law as units, are obliged to ensure their protection."
Through the methodological norms of law enforcement, approved by HG no. 301/2012, it is stipulated that: "The adoption of security measures for the objectives, assets and values provided for by law is carried out on the basis of a physical security risk analysis."
The initial deadline, set for January 1, 2015, regarding the obligation to prepare the physical security risk analysis, was successively extended, the last time by GD no. 437/2017 until July 1, 2018, for units established before June 16, 2012.
